Senate Republicans are circulating revised language for the CLARITY Act ahead of a crucial September 15 procedural vote, with negotiations still unresolved over ethics restrictions, anti-money-laundering requirements, stablecoin rewards and protections for decentralized finance developers.

According to @coinbureau, the revised draft was being circulated as lawmakers prepared for the vote, while Democrats have argued that the legislation remains insufficient. The Senate needs 60 votes to invoke cloture, compared with 53 seats currently held by Republicans.

The latest developments indicate that Republicans have since released a 630-page version of the legislation, meaning the full text is now available despite the earlier report that it had not been made public. The revised version includes new provisions governing certain non-decentralized finance trading protocols and would direct the Commodity Futures Trading Commission and Treasury Department to develop related rules.

CLARITY Act Faces Key Policy Disputes

The ethics provisions remain one of the most politically sensitive issues. The legislation has faced scrutiny over potential conflicts involving President Donald Trump and his family's cryptocurrency interests, including reported income of more than $1.4 billion from those ventures.

Earlier Senate language included restrictions on federal officials and their spouses issuing or sponsoring digital assets, with enforcement assigned to the Justice Department and a sunset date in January 2029. Democratic lawmakers have argued that the provisions do not go far enough.

Other unresolved areas include anti-money-laundering safeguards and the treatment of rewards associated with stablecoins. Banking and crypto industry groups have pressed lawmakers over how stablecoin-related incentives should be treated under the broader market-structure framework.

DeFi developer liability is another major fault line. The revised legislation adds provisions addressing certain protocols while attempting to distinguish decentralized software from systems controlled or materially altered by identifiable parties.

60 Votes Remain the Immediate Hurdle

The September 15 vote is a procedural cloture vote on whether the Senate can formally begin considering the CLARITY Act. It does not itself enact the legislation, and further procedural steps would be required before final passage.

With Republicans holding 53 seats, at least seven Democratic or independent senators would need to join them if every Republican supports the motion. Any Republican financial defections would raise the number of votes required from across the aisle.

The immediate test for the bill will therefore be whether negotiators can resolve the remaining disputes and assemble the 60-vote coalition needed before the Senate's September 15 cloture vote.
